ACTU : CPI : ouverture d'une enquête sur la guerre Géorgie-Russie de 2008
La Cour pénale
internationale (CPI) a autorisé, le 27 janvier, la procureure à enquêter sur la
guerre éclair d'août 2008 ayant opposé Géorgie et Russie pour le contrôle de
l'Ossétie du Sud. A cette occasion, la CPI ouvre sa première enquête sur des
crimes présumés commis par des forces russes et sa première enquête aussi sur un
conflit non africain.

Bien que le centre de gravité historique de ce droit fondamental réside dans sa dimension individuelle, les juges sont fréquemment confrontés à des aspects « institutionnels » ou communautaires de la liberté de religion : des droits revenant aux groupements religieux comme tels.

Depuis la crise financière de 2008, c’est-à-dire le sauvetage des banques par les États qui furent ensuite rançonnés par ces mêmes banques, sont apparus dans le monde des mouvements de protestation en dehors des partis politiques traditionnels ou en marge des institutions. Dans les pays occidentaux, le sauvetage des banques a galvanisé les oppositions en dehors des partis traditionnels qui avaient tous collaboré au sauvetage par l’argent public. Les indignés espagnols criaient, à juste titre, « ce n’est pas une crise mais une escroquerie ». Le petit livre de Stéphane Hessel, Indignez-Vous !, a parfaitement cristallisé le sentiment de nombreux citoyens choqués par les réponses à la crise de leurs dirigeants. Ailleurs dans le monde la crise financière était seconde par rapport aux préoccupations locales.

ACTU : La Sous-Secrétaire générale aux affaires humanitaires de l’ONU dénonce l’utilisation de la famine comme arme de guerre en Syrie

Au cours d’une
réunion sur la Syrie qui s’est ajoutée au programme de travail du Conseil de
sécurité, le 15 janvier 2016, en raison de la situation grave qui prévaut
actuellement dans la ville assiégée de Madaya, la Sous-Secrétaire générale aux
affaires humanitaires, Mme Kyung-wha Kang, a tiré la sonnette d’alarme sur le
sort d’une population qui est délibérément privée de vivres. « La
famine, a-t-elle dit, appuyée en ce sens par de nombreux intervenants, est
utilisée comme arme de guerre par les belligérants ». Toutes les
parties, y compris le Gouvernement syrien, commettent des actes terribles
interdits par le droit international humanitaire, a-t-elle ajouté en demandant
au Conseil de dénoncer la nature barbare de ces tactiques.

NOTE : Is Russia Withdrawing from Rule of Law Principles?

Between 2013 until
mid-2015, around 45.000 Russians have turned to the European Court of Human
Rights (ECHR) in Strasbourg (Moscow Times, 10.12.2015). The majority of
cases was decided against the Russian administration, for the protection of
Russian citizens. The ECHR can rule also against a Constitution of a signatory
State – which was the case e.g. in an equality and non-discrimination case
against Germany where the Constitution had ruled that women cannot fight in the
army, neither fight in combat troops. A female future helicopter pilot
had this examined legally, and won finally. The German Constitution had to be
changed. So, the ECHR is a (not only constitutional) watchdog, with many
judgments in favour of judicial rights of the citizens. Since Eastern European
States are subject of ECHR decisions, there is a certain tendency in favour of
a liberal society, abiding to the rule of law. It is good to have international
courts in Europe, and the ECHR and its EU counterpart, the Court of European
Justice (CEJ) in Luxembourg have all confidence of the citizens. These courts
are a guarantee of the sum of all positive legal traditions.

This book examines hybrid tribunals created in Sierra Leone, Kosovo, Cambodia, East Timor, and Lebanon, in terms of their origins (the political and social forces that led to their creation), the legal regimes that they used, their various institutional structures, and the challenges that they faced during their operations. Through this study, the author looks at both their successes and their shortcomings, and presents recommendations for the formation of future hybrid tribunals.

ACTU : Territoires palestiniens occupés : démission du Rapporteur spécial de l'ONU pour les droits de l'Homme

Le Rapporteur spécial des Nations
Unies sur la situation en matière de droits de l'Homme dans les territoires
palestiniens occupés, l'Indonésien Makarim Wibisono, a démissionné le 4
janvier, en raison de son manque persistant d'accès à ces territoires, a
annoncé le Haut-Commissariat des Nations Unies aux droits de l'Homme (HCDH)
dans un communiqué. Sa démission prendra effet le 31 mars 2016.
